Labour Court sets aside extension for Patrick Baggott’s age discrimination complaint

The Labour Court allowed Abbott Vascular’s appeal and set aside an extension of time for Patrick Baggott to refer an age discrimination complaint. The determination was dated 5 November 2012. Mr Baggott did not attend the appeal hearing; the merits of the discrimination complaint were not decided. The Equality Tribunal had extended the referral period after Mr Baggott said moving to the United States amid economic conditions had taken up his time. Abbott Vascular argued that this did not explain why he could not file earlier. The Labour Court found the explanation neither explained nor excused the delay and that reasonable cause for an extension had not been shown.
