In 2003, the Labour Court refused Charlotte O'Driscoll an extension of time to bring her Employment Equality Act claim against F.M.L. Properties Limited. The Court found the claim was brought outside the six-month time limit and was not well founded; the merits were not decided. O'Driscoll had been dismissed on 7 June 2002, and her claim reached the Court on 6 March 2003. The Court found that sending the claim to the wrong organisation was not enough to establish exceptional circumstances. Its decision was dated 7 May 2003.
