The Labour Court found a worker’s age-related dismissal complaint against Kingspan Building Products was not out of time, but said it had no jurisdiction at that stage to consider her separate complaint about appointment to a permanent post. The Court’s decision was dated 11 April 2002. SIPTU had applied on the worker’s behalf for an extension to bring a claim. The Court found a letter dated 24 October 2001 formally referred the dismissal complaint within six months of the alleged dismissal on 22 June 2001. The permanent-post allegation concerned December 2000 and, the Court said, could only be investigated by the Director of Equality Investigations at first instance. Neither allegation was decided on its merits.
