In 1996, the Labour Court found that a worker was constructively dismissed after a restaurant company’s personnel manager sexually harassed her. The Court directed the company to pay £2,000 compensation. Its order was signed on 7 October 1996.
The worker said the manager made sexual advances despite her objections. He denied harassment and constructive dismissal. The Court found he continued making advances against her express wishes, leaving her unable to work near him.
Although the incident took place outside normal working hours at the manager’s home, the worker had a prior arrangement to change there before work. The Court treated the home as her workplace for that purpose and held the employer responsible for the manager’s conduct.
