In 1993, the Labour Court found that Carroll Joinery (International) Limited and Rationel Vinduer Limited trading as Rationel Vinduer discriminated against Josephine Kilally by dismissing her because the companies wanted to employ a man instead. It ordered £1,500 compensation. The order was dated 5 October 1993.
The Court found that no proper redundancy situation existed and that, even if one had, a male worker with less service and experience should have been selected. The companies said Kilally had indicated she wished to be made redundant and that the decision was commercial.
