The Labour Court found that Eircom Ltd had complied with its earlier determination requiring it to offer Bridget Gertrude Boland the next acting-up position, subject to offering her the Dublin post again. In its order dated 24 November 2003, the Court said she should not have to sign a document confirming the post was temporary. Boland had applied for implementation, arguing that the Waterford offer was impractical and the Dublin post was wrongly graded. Eircom said she had rejected both offers and that it had paid the €20,000 awarded by the Equality Officer and the €4,000 awarded by the Court in the earlier case. The Court accepted that Eircom had acted in good faith in offering the Waterford position, and found that the Dublin post at its stated grade met the earlier determination. It directed Eircom to make the Dublin offer again, leaving Boland to decide whether to accept it.
