Labour Court says Dublin City Council implemented Jacqui McCarthy determination

The Labour Court found that Dublin City Council had fully implemented its earlier determination in Jacqui McCarthy’s case, but said it could not rule on whether tax and PRSI had been deducted correctly. The Court said that tax question should be put to the Revenue Appeals Commissioners. The earlier determination awarded McCarthy €20,000 for distress after victimisation and a further €5,000 under the Employment Equality Act 1988. The Council deducted tax and PRSI from the payments after receiving instructions from the Revenue Commissioners. The Labour Court signed its order on 15 April 2003. It said the tax classification was not reviewable under section 24 of the Employment Equality Act 1997 and that it had no jurisdiction under tax law to decide the issue.
