The Labour Court found that a worker was sexually harassed by a store manager and that her dismissal was mainly attributable to her complaint. It awarded her £20,888.40, equal to two years’ remuneration, in a determination signed on 9 March 2001.
A retailer said it dismissed the sales assistant for dishonestly reducing the price of clothes for a colleague, causing a £60 loss. The Court found she had not freely admitted fraud and that the investigation was procedurally unfair. It also found the retailer had not shown that the dismissal was unconnected to her harassment complaint.
The Court found that the worker had been sexually harassed and made her complaint in good faith. It concluded that her dismissal was mainly due to that complaint and that she had been penalised. In setting compensation, the Court cited the harm to her wellbeing, good name and future employment prospects.
