The Labour Court rejected Marilyn O Ramos’s complaint that Promowear Limited discriminated against her on gender and race grounds by dismissing her during maternity leave. The Court dated its determination 10 April 2006.
Ramos said she sought extra leave after maternity leave and was dismissed. Promowear said she had resigned because she would not return. The Court accepted that the employer could reasonably understand she had resigned, noting she had not reported for work and later sought her P45. It also found she was not disadvantaged by language difficulties or cultural differences. The Court determined that she was not dismissed in circumstances amounting to discrimination on either ground.
