In 2003, the Labour Court found that PRK Logistics Limited discriminated against Mary Conroy on grounds of gender when selecting her for redundancy and ordered the company to pay €5,000 compensation. The determination was signed on 7 July 2003.
PRK Logistics said it had to reduce costs and selected Conroy and another driver for redundancy on a last-in, first-out basis. The Court found that basis was inaccurate and accepted Conroy's evidence that she had been told she was unsuitable because she could not lift heavy weights unaided. It found that male employees had similar difficulties and that the company drew an unwarranted connection between her difficulty and her gender. The Court was not satisfied the company had rebutted the inference that gender influenced her selection.
