Labour Court awards €7,500 to worker dismissed because of disability

The Labour Court awarded a worker €7,500 after finding that a restaurant dismissed her because of her disability. The determination was signed on 9 April 2003.

The worker, who worked part time as a waitress, said the manager told her she was being dismissed because of her epilepsy. The restaurant said she was unsuitable for the job and had failed to meet the required standards.

The Court accepted the worker’s account, finding that disability was the dominant or only reason for her dismissal. It also found that she was capable of doing the work and had received no complaints or warnings about her performance. The restaurant was liable for the manager’s actions. The award took account of financial loss and stress.
