The Labour Court found that Michelle Fox was dismissed from her job at Peking House because she was pregnant and ordered the restaurant’s owners, Mr Kwok Lee and Mrs Yuk Lui Lee, to pay her €25,000 compensation. The determination was signed on 18 February 2003.

Fox had worked at the Sligo takeaway as a counter assistant before being promoted to manager. The Lees said they dismissed her for misconduct and alleged financial irregularities. The Court preferred Fox’s account, found there had been no grounds for misconduct and said the financial allegations had no basis. It also noted a reference signed by Mrs Lee said Fox was let go because she was pregnant.
