The Labour Court awarded a worker €15,000 after finding that her dismissal amounted to victimisation because she complained about alleged sexual harassment. The determination was dated 18 February 2003.
The worker said she had reported alleged harassment to management and was dismissed shortly afterwards. The company denied both the alleged incidents and that she had reported them. The Court made no finding on whether the harassment occurred.
The Court found that the farm manager knew of the complaints and took them into account in deciding to dismiss her. It found no reasonable basis for concluding that she had not acted in good faith, and said her dismissal resulted wholly or mainly from making the complaints. The award took account of her financial loss and distress.
