The Labour Court found that Sabrina McNern was dismissed because of her pregnancy and awarded her €15,000 compensation. The determination was signed on 14 November 2002.
McNern worked at Blooms Hotel, run by Martin Keane, who said her dismissal resulted from redundancy. The Court found pregnancy was a significant issue in discussions with her and that the hotel later advertised reception and accommodation jobs despite saying there were no vacancies.
Keane did not attend the hearing, and the Court held that he had failed to rebut the presumption of discrimination. It found the complaint well founded. The €15,000 award was in addition to the £1,298.44 (€1,648.68) already paid to McNern.
