The Labour Court dismissed a bar worker’s complaint that Sashore Limited, trading as Jacksons Restaurant, dismissed him because of his sexual orientation. The determination was signed on 29 August 2002. The company said the dismissal followed an altercation between two employees who refused to work together. The worker argued that he had not been given a chance to explain his side and cited an earlier incident involving his partner. The Court accepted that the company had to choose between the two employees and found the evidence did not establish a connection between the worker’s sexual orientation and his dismissal.
