The Labour Court awarded a worker €15,000 after finding that her employer dismissed her in circumstances amounting to discrimination on grounds of nationality. The determination was dated 13 May 2002.
The worker said she had come to Ireland for a nursing-home job but was instead given factory assembly work. The Court found that she was treated differently from an Irish national because of her nationality, and that the company terminated her employment. The company denied discrimination and said it had concerns about her conduct and work.
Her separate gender discrimination complaint, which included sexual harassment allegations, failed because the evidence did not raise a presumption of unlawful discrimination. The Court also recommended that employers recruiting non-national workers provide induction courses and resources to address social and cultural differences.
