The Labour Court rejected Chirag Vinod Malhotra’s appeal, finding that poor performance was the reason Allergy Standards Limited dismissed him. The Court dated its determination 4 June 2025.
Malhotra said his dismissal followed his request for parents’ leave and came shortly after his second child was born. Allergy Standards said its concerns related to his sales performance. The Court found that the performance process coincided with his leave applications and his child’s birth, but that this did not show either caused his dismissal.
The Court found that Malhotra had not established facts supporting an inference of family-status discrimination. He withdrew two related penalisation appeals at the hearing. The Court declined his request to amend those claims into unfair-dismissal claims because it could not take first-instance jurisdiction.
