The Labour Court rejected Paul O’Sullivan’s gender discrimination appeal against Apple Operations Europe Limited, upholding the finding that he had not established discrimination. The Court’s determination was dated 26 July 2023.
O’Sullivan argued that two female colleagues doing the same work received higher pay. He said permanent assemblers received €1,671 more per year than workers on long-term flex contracts. Apple said the difference reflected a 2015 agreement that protected the existing terms of permanent staff while creating a separate long-term flex category.
The Court noted that no one had joined the red-circled group since the long-term flex grade was introduced. It found that the higher pay was for reasons other than gender and did not constitute discrimination. The appeal failed, leaving the original decision in place.
