The Labour Court upheld the rejection of a hospital worker’s victimisation complaint after she appealed a WRC decision over a promotion competition at St Vincent’s Hospital. The decision, dated 11 November 2022, found she had not established a prima facie case in the competition during the period covered by her complaint.
Ms Adelina Soit said the hospital mishandled confirmation of her interview, assessed her on a question she said had not been asked and failed to provide the interview questions in feedback. The hospital said candidates were assessed consistently and she failed the change competency because she gave no example. The Court found no evidence meeting the threshold for victimisation or discrimination in the relevant period, so it could not examine alleged earlier acts. Her appeal failed.
