The Labour Court set aside a €2,000 age discrimination award to Jade Byrne-Hoey after Hyde And Seek Glasnevin’s appeal, and rejected Byrne-Hoey’s cross-appeal for higher compensation. The determination was signed on 26 October 2021.
Byrne-Hoey, a childcare assistant, said she was treated less favourably because of her age after an incident with a colleague and a warning the following day. Hyde And Seek Glasnevin said the warning arose from a separate office incident and denied that age was a factor.
The Court found the age difference between Byrne-Hoey and her colleague was not enough on its own to support an inference of discrimination. It also found that nothing said or done by the employer linked her treatment to her age. The adjudication officer’s decision and award were set aside.
