The Labour Court overturned a finding that Anthony Moran had discriminated against Magdalena Kanik on gender grounds, after Moran appealed the adjudication officer’s decision. The determination was signed on 19 October 2021.
The original decision had upheld Kanik’s gender complaint but found her family status complaint misconceived. At the Labour Court hearing, Kanik said she was no longer pursuing the family status claim and could identify no gender discrimination breach within the relevant period. She also accepted that her employment had ended by redundancy on 7 January 2018.
Moran disputed that Kanik had been discriminated against. The Court found she could identify no breach of the Employment Equality Acts during the reckonable period and overturned the adjudication officer’s decision. Kanik had worked at Moran’s Dublin gift shop from September 2012 and went on maternity leave in May 2017. The shop ceased trading in January 2018.
