The Labour Court upheld the rejection of Violeta Cucovic’s discrimination complaint against the Mental Health Commission, in a determination dated 13 July 2021.
Cucovic, a clerical officer, appealed the adjudication officer’s decision under the Employment Equality Acts 1998–2015. She alleged unfair treatment, exclusion and bullying by colleagues and managers. The Commission denied discrimination.
The Court found the allegations did not link the alleged conduct to a protected ground and said speculation and unsupported assertions were insufficient to establish that discrimination had probably occurred. The complaint was not well founded, and the adjudication officer’s decision was affirmed.
