The Labour Court dismissed Sinead Day’s appeal, finding she had not established gender discrimination in pay or conditions of employment at Waterford Institute Of Technology. The determination was signed on 4 February 2021. The Court found Day had not applied for study leave during the relevant period and had not shown that the allocation of international markets was linked to gender or amounted to unfavourable treatment. It also found she earned more than her comparator and that his higher annual leave entitlement was linked to his academic post, which she had declined. The Court affirmed the Adjudication Officer’s decision.
