The Labour Court upheld a decision that Anthony Mc Cabe’s disability discrimination complaint against Boliden Tara Mines Limited was brought outside the time limit. The Court’s determination was dated 24 January 2020; it did not decide the merits. Mc Cabe argued that his employment continued until he reached retirement age in 2016 because income-continuance payments funded contributions to the company pension scheme. Boliden Tara Mines Limited argued that his employment ended in 1991 and that the complaint was out of time. The Court found that a letter dated 29 October 1991 clearly terminated his employment. Continued pension contributions did not create an ongoing employment relationship.
