The Labour Court rejected Peter Tobin's age discrimination appeal against Mounttown Community Facility CLG, affirming the Adjudication Officer's decision. The determination was dated 15 April 2019.
Tobin alleged he was compelled to retire at 68 after managing the facility from 2010 until September 2017. Mounttown said the post depended on Pobal funding, which could not support employees aged 66 or older who qualified for the State pension.
The Court found Tobin was not dismissed because of his age. His post was substantially funded by Pobal and subject to eligibility rules he ought to have known. It also found he remained employed beyond 66 because of an oversight by the Board, Pobal and Tobin.
