The Labour Court upheld a decision rejecting Edel Whelan’s family-status discrimination complaint against her former employer, Power City. The determination was signed on 19 February 2019.
Whelan said Power City did not facilitate her request to transfer to an evening-and-weekend vacancy because of her family status. Power City said the vacancy had fewer hours than she was working and that the employee who took it had the same family status.
The Court found that the proposed comparator had the same family status as Whelan, so she had not established a case of discrimination. The complaint therefore could not succeed.
