The Labour Court increased Karen Kelly’s compensation to €51,168 after finding that G4S Secure Solutions (Ireland) Limited discriminatorily dismissed her when she returned from maternity leave. Its determination was dated 12 June 2019. The Court dismissed G4S’s appeal and amended the adjudication officer’s decision, which had awarded €11,602.50.
Kelly had worked at the company’s Swords site on a permanent contract. After her maternity leave, G4S offered her temporary work at its Ballymount head office, involving a four-hour daily round-trip commute. The Court found those terms less favourable than her previous job and rejected the argument that a client’s site request overrode her statutory rights.
The Court also rejected G4S’s claim that Kelly resigned by requesting her P45. It set compensation at the maximum it could award.
