The Labour Court set aside a €24,000 discrimination award to Hazel Sheehan and upheld Rio's Takeaway Limited Rio's appeal in a determination dated 10 January 2018. The Adjudication Officer had found that the company discriminated against Sheehan in her dismissal and conditions of employment.
Sheehan said she was moved to the Parnell Street outlet after telling her manager she was pregnant and was suspended after a food-preparation incident. The company said the move was jointly agreed to address her concerns. The Court preferred the company's witnesses' account of that agreement, found no evidence the move reduced her earnings, and concluded Sheehan was not suspended. It also found the company's conduct did not amount to constructive dismissal.
