The Labour Court rejected Agnieszka Nowak’s appeal over three race-discrimination complaints against Intesa Sanpaolo Life Limited, affirming the adjudication officer’s decisions. The determination was dated 31 August 2018.

The complaints concerned a promotion, exclusion from flexitime and equal pay. On the promotion complaint, the Court found that Nowak had not applied for the team-leader vacancy or approached the company about it, and had identified no person treated more favourably in a way that supported an inference of discrimination.

On flexitime, the Court found no evidence linking her exclusion to race; the evidence suggested that part-time work was the main reason for her exclusion. On equal pay, it found no evidence that she was paid less than another employee doing the same or similar work. All three complaints were not well founded, and the appeal failed.
