The Labour Court rejected Olumide Smith’s appeal against Cisco Systems Internetworking (Ireland) Limited, finding that he had not been discriminated against on grounds of race. The determination was dated 26 April 2018.
Smith said race affected his dismissal, pay and promotion, and that Cisco victimised him after he complained of racism. Cisco denied discrimination and said Smith’s pay exceeded that of the three comparators he named.
The Court found no link between Smith’s race and the dismissal process. It found that he had identified no promotion failure or victimisation within the period it could consider. Smith accepted that his three comparators were paid less than he was, so his race-related pay complaint failed.
The Court refused to extend the time limit for complaints about events before 29 May 2013, finding that Smith’s search for unspecified documents did not explain the delay. It could not consider those earlier events. The dismissal and pay complaints were not well founded, while the promotion and victimisation complaints failed. The Court affirmed the Adjudication Officer’s decision.
