The Labour Court upheld a finding that J & M Golfing Cuisine harassed Glenn Curtis on the ground of race, but reduced his compensation from €8,500 to €3,500. The Court dated its determination 20 March 2018 after hearing the employer’s appeal, which concerned only the harassment claim.

Curtis worked as a catering assistant and barman at Edmonstown Golf Club. He said a manager, Mr Rahman, regularly made racist remarks; Rahman denied this. Curtis’s account was supported by a former colleague. The Court found the employer had not rebutted the harassment case and noted it had no written dignity at work or anti-discrimination policy.

The Adjudication Officer had also rejected Curtis’s separate claims of race discrimination in his working conditions and constructive discriminatory dismissal. Curtis did not appeal those findings. The Labour Court varied the harassment award to €3,500, which it said was not compensation for loss of earnings and was not subject to income tax.
