The Labour Court overturned an Adjudication Officer’s decision and found that Katarzyna Wozniczka was victimised by her employer, Couverture Limited. In a determination dated 11 January 2018, it ordered the company to pay her €25,000 compensation.
Wozniczka said Couverture dismissed her after receiving notice of her equality complaint. The company said the dismissal followed discussions about her role after she returned from maternity leave and rejected alternative work.
The Court found the timing raised a presumption of victimisation. Couverture’s managing director told the Court that notification of the complaint had influenced her decision to give effect to the redundancy that afternoon. The Court found the complaint well founded and set aside the earlier decision.
