The Labour Court upheld the decision against Margaret Burke in her appeal alleging disability discrimination and failure to provide reasonable accommodation by Connaught Electronics T/A Valeo Vision Systems. The determination was signed on 14 March 2018.
Burke sought a seated role after returning to work. The company said it had arranged a shift transfer, a phased return and a move to a different work area. It also said doctors had certified her fit for standing work and that permanent seated production jobs were not available. After receiving a consultant’s request for seated work, the company assigned Burke to a temporary vacancy in November 2015.
The Court found that the company had made reasonable accommodation for Burke’s return to work and had imposed no detriment because of her disability. It found she was not discriminated against by the delay in granting her request for a seated role, and upheld the Adjudication Officer’s decision.
