The Labour Court affirmed a finding that Marie Fogarty was not harassed on family-status grounds by Campbell Catering Limited, trading as Aramark Ireland. The Court signed its determination on 16 February 2018. Fogarty, a catering assistant at Portiuncula Hospital, argued that a manager’s question about her daughter amounted to harassment. The employer said the manager had raised the matter after colleagues reported a concern about Fogarty’s hair. The Court accepted the manager’s explanation for the office conversation and found it was not connected to Fogarty’s family status. It treated a later ward-kitchen interaction as a separate attempt to apologise, unrelated to family status, and found that neither interaction amounted to harassment. The Court affirmed the Adjudication Officer’s decision and Fogarty’s appeal failed.
