Labour Court rejects Seamus Counihan’s disability discrimination appeal

By Orla Quinn

Labour Court ·

The Labour Court disallowed Seamus Counihan’s appeal and affirmed the finding that his disability discrimination complaint was not well founded. The determination was dated 24 January 2018. Counihan argued that Swan O’Sullivan Accountants & Registered Auditors dismissed him because of a disability. The firm said his dismissal followed performance concerns and that it did not know he had a disability. The Court found that he had not established a disability at the relevant time or that the firm knew, or should have known, about one. It found no facts from which discrimination could be inferred.
