The Labour Court rejected a worker’s appeal over harassment and victimisation complaints against Waterford City and County Council, affirming the Adjudication Officer’s decision. The determination was signed on 5 January 2018. The worker argued that a workplace notice and delays in implementing an equality report amounted to harassment. She also said her continued paid leave amounted to victimisation after she had complained of gender discrimination. The council said the union had requested the leave and that the worker was facilitated when she wished to return. The Court found no evidence that the notice violated the worker’s dignity or created a hostile environment, and accepted the council’s explanation for handling the equality report. It also found no facts connecting the continued paid leave to her earlier discrimination complaint. The council’s earlier finding of gender discrimination was not appealed.
