The Labour Court rejected Daiga Sprance’s appeal over alleged sexual harassment and discriminatory dismissal, finding both complaints not well founded. The determination was dated 20 June 2017.

Sprance appealed an Adjudication Officer’s decision concerning her employment with Mitie Facilities Management Limited, where she worked on a zero-hours contract covering absent staff at a client’s premises. She said a fellow employee sexually harassed her and that MITIE failed to investigate after she reported it.

The Court preferred MITIE’s evidence, describing Sprance’s evidence as contradictory and unreliable. It found she had not established facts supporting an inference of discrimination and affirmed the earlier decision on the harassment complaint.

On the dismissal complaint, Sprance told the Court she had not been dismissed as claimed. The Court found that complaint not well founded and dismissed the appeal. Her appeal forms did not include other complaints addressed in the earlier decision, including race discrimination in working conditions and victimisation.
