Labour Court upholds refusal to extend Juanita Wilkinson’s discrimination claim deadline

Labour Court ·

The Labour Court upheld the refusal to extend Juanita Wilkinson’s time to bring a discrimination complaint against Servier Ireland Industries Lmited. In a determination dated 19 May 2017, the Court found she had not shown reasonable cause for referring her complaint about 10 months after the most recent alleged discriminatory event. The merits were not decided. Wilkinson said pregnancy complications and lack of awareness of the deadline explained her delay. The Court found no link between her pregnancy difficulties and the delay, and said ignorance of legal rights could not justify failing to bring a claim in time.
