The Labour Court rejected tram driver Michael Chrzanowski’s appeal against Transdev Light Rail Limited’s decision to retire him at 65, finding his age discrimination complaint was not well founded. The determination was signed on 29 November 2016.

Chrzanowski argued that retiring him on his 65th birthday was discriminatory. The Court found that a retirement age of 65 applied to him and was justified by safety concerns for drivers, passengers and the public, as well as workforce planning. It also found that CIE companies were not appropriate comparators. Two other claims, about discrimination in getting a job and dismissal for opposing age discrimination, were withdrawn at the appeal hearing.
