The Labour Court disallowed Bernadette Moore’s appeal against the dismissal of her age discrimination complaint over a special needs assistant job at Gaelscoil Chill Dara. The determination was dated 2 November 2016. Moore said she was not selected because of her age and challenged the interview process. The school denied discrimination and said candidates were assessed on qualifications, professional ability, teamwork, experience and interview performance. The successful candidate scored 227 marks out of 300, compared with Moore’s 207, and had previous special needs assistant experience. The Court found no evidence of unfairness or irrationality in the selection process and said the criteria had been applied consistently. It concluded that the complaint could not succeed and affirmed the Adjudication Officer’s decision.
