The Labour Court upheld a €30,000 compensation award to a worker after finding that a major retailer failed to properly consider adjustments that could have enabled her to return to work. The determination was signed on 7 October 2016, following the retailer’s appeal.
The worker, a sales advisor assigned to the bakery, sought to return on light duties in another area of the store. The retailer required her to be fully fit for her existing role. The Court found it had not adequately considered possible adjustments, including whether tasks could be reallocated. It said the retailer might have concluded that accommodation was not possible, but had failed to assess the available options.
The Court directed the retailer to pay the award within 42 days and ordered a review of its employment policies and procedures, particularly those relating to disability. The worker was represented by Mandate.
