The Labour Court upheld a finding that Tom Moloney Limited T/A Squire Maguire's discriminatorily dismissed Thomas Keogh and increased his compensation from €12,000 to €16,000. Its determination was signed on 1 July 2016, after the employer appealed the original award.
Keogh worked as a barman at the employer's public house in Limerick City. He said the employer refused to let him return after he supplied a medical certificate confirming he was fit for work. The employer said it was concerned for his welfare and wanted confirmation that he could cope with the pub environment, and denied dismissing him.
The Court preferred Keogh's account and found that the employer delayed and obstructed his return after he was certified fit. The appeal concerned only the discriminatory dismissal finding. The separate complaints about conditions of employment, harassment and reasonable accommodation had failed and were not appealed, so the Court did not reconsider them.
