The Labour Court allowed Salesforce.Com’s appeal and set aside the extension of time granted to Alli Leech to bring a discrimination claim. Its determination was dated 30 June 2016. Leech alleged discrimination over a promotional opportunity.
Leech said she delayed making an external complaint because of advice to avoid stress during pregnancy and, later, a wrist injury. The Court found no clear evidence that pregnancy-related advice caused the delay and no medical evidence that the injury treatment justified the further delay. It concluded that she had not established a causal connection between those factors and the late filing. The Court did not decide whether discrimination occurred.
