The Labour Court upheld the Equality Tribunal’s decision after an equal-pay appeal by Aleksandrovs, Sidorov, Rikmanis, Timofejus and Sinicins against Roskell Limited failed. The determination was signed on 30 November 2015.
The five workers said they did like work to an Irish comparator who was paid more, and alleged race discrimination. Roskell accepted there was a pay disparity but said the comparator had additional responsibilities, including checking bulk orders and supervising the Northern Ireland picking line.
The Court found the workers had not established that their work was of equal value to the comparator’s. It accepted that the pay difference arose from his additional duties and found no inference of less favourable treatment on race grounds.
