Labour Court sets comparator pool in CPSU equal-pay case

In a preliminary determination signed on 26 November 2015, the Labour Court set the comparator pool for an equal-pay claim by 14 CPSU members who worked as clerical officers in Garda stations. They sought equal pay with members of An Garda Síochána. The Department of Justice, Equality and Law Reform argued for comparators among Garda-rank members who performed clerical work, while CPSU argued for members in designated posts. The Court said the pool should include Garda-rank members doing clerical work beyond a de minimis extent, including those also performing ordinary policing duties, but not the entire force. It invited further submissions on selecting comparators; the substantive claim was not decided.
