Labour Court rejects Sodexo worker’s disability appeal

The Labour Court disallowed Michal Wojcik’s appeal against a finding that Sodexo Ireland Limited did not discriminate against him or fail to provide reasonable accommodation. The determination was signed on 23 November 2015.

Wojcik worked as a security guard at Cappagh Hospital in Finglas, Dublin. He argued that day-only or night-only rosters would have cut his weekly hours by 33% and treated him less favourably because of his disability. Sodexo said the proposed changes reflected medical advice and offered him work at a site outside Dublin, which he declined.

The Court found the revised rosters did not amount to discriminatory treatment. It also found that the roster proposals and offer of another site were appropriate measures, and that Sodexo had discharged its duty to provide reasonable accommodation.
