The Labour Court disallowed Rena Burke’s appeal over her failure to be shortlisted for deputy principal at St. Nathys College, affirming the Equality Tribunal’s decision. The determination was signed on 28 July 2015.

Burke argued that the reason given for not shortlisting her implied she was not Catholic. The College said her application was poorly presented and did not show enough commitment to the school’s Catholic ethos.

The Court considered criticism of the application’s quality harsh, but found no evidence that the College had imputed a different religion to Burke. She and the four shortlisted candidates were Catholic, and her application referred to parish council membership and named a Catholic priest as a referee.
