Labour Court upholds finding against worker in Public Appointments Service appeal

The Labour Court disallowed a worker’s appeal and upheld the Equality Tribunal’s finding that the Public Appointments Service had not discriminated against her or victimised her. The determination was dated 20 February 2014. The worker alleged disability discrimination, failure to provide reasonable accommodation and victimisation. The Court found no discrimination over a requested transfer to the Recruitment Unit, saying the service was still considering the possibility and had made no definitive decision when she brought her claim. It found the complaint about her return to work in 2008 was out of time. Her complaint about flexi-time supervision failed because the Court found no causal link to an earlier equality claim.
