The Labour Court rejected Sundra Mullen’s appeal against the dismissal of her race discrimination complaints against Apparel Supply Solutions Limited (Formerly Teamkit Limited). The determination was signed on 11 February 2014. The Court found no evidence to substantiate her allegations and agreed with the Equality Officer’s findings. Mullen alleged discrimination in promotion, working conditions and dismissal. The company denied discrimination and said it handled disciplinary issues fairly and consistently. The Court found it had no jurisdiction over the discriminatory dismissal complaint because the dismissal had already been considered by the Employment Appeals Tribunal. Alleged incidents before 5 February 2010 were outside the time limit, and the Court found no evidence of discrimination during the period within time apart from the dismissal. Her appeal failed; the €7,500 awarded by the Employment Appeals Tribunal was for a separate unfair dismissal case.
