The Labour Court disallowed Sarah Curran’s appeal against the Department of Education and Science and affirmed the Equality Tribunal’s decision. The determination was signed on 4 March 2013.
Curran argued that limiting access to a primary teacher training scheme to residents of designated Gaeltacht areas discriminated on race grounds because Gaeltacht residents were a distinct ethnic group. The Court said expert evidence was needed to establish that claim and adjourned to allow Curran to provide a report. She did not submit one despite reminders and a deadline.
The Court found there was no evidence before it that Gaeltacht residents formed a distinct ethnic group for the purposes of the Acts. It therefore disallowed the appeal and affirmed the Tribunal’s decision.
